TRCBeacon Terms of Service

Effective date: October 12, 2026

These Terms of Service (the "Terms") are a binding agreement between Rivo Labs LLC, a limited liability company organized in New Mexico, USA (File # 3308017), with its registered address at 1209 Mountain Road Pl NE, #10346, Albuquerque, NM 87110, USA (the "Provider", "we", "us"), and the person or entity using TRCBeacon (the "Client", "you"). They govern the TRCBeacon blockchain wallet monitoring service available through our website at https://trcbeacon.com, our Telegram bot @trcbeaconbot and our API (together, the "Service"). The Acceptable Use Policy (the "AUP") and the Privacy Policy are part of these Terms.

1. Acceptance and eligibility

1.1. By registering, adding an address, paying for a plan or otherwise using the Service you accept these Terms. If you act for a company, you confirm that you are authorised to bind it, and "you" includes that company.

1.2. You must be at least 18 years old and have legal capacity to enter into a contract.

1.3. You may use the Service only if you comply with Section 4 (Territory and sanctions). The Service is not offered where use would be unlawful for you or for us.

2. The Service

2.1. The Service monitors public blockchain addresses that you add. Initially it supports the TRON network; additional networks (including EVM-compatible networks) may be added. For monitored addresses the Service (a) detects transfers and sends notifications to Telegram and to webhook endpoints you configure, (b) shows AML flags based on public lists, currently the list of frozen addresses published by Tether and the OFAC Specially Designated Nationals ("SDN") list, and (c) provides the other features of your plan.

2.2. The Service is read-only. We do not hold, store or request private keys, seed phrases or passwords for any wallet. We do not initiate, sign, relay or execute transactions. We do not hold, custody, transmit, exchange or manage your funds or virtual assets, and we have no access to them, except for payments made to us, including payments blocked under Section 4.5. The Service is not a wallet, exchange, payment processor, custodian, money transmitter or financial institution.

2.3. Monitoring covers events from the time an address is added; the Service does not provide history before that time unless your plan expressly says so.

2.4. Blockchain data is public. We do not verify who owns or controls an address and do not de-anonymise any person.

2.5. We may modify, add or remove features, networks or integrations. If a change materially reduces the functionality of a paid plan, Section 8.3 applies.

3. Information only; no advice

3.1. Notifications, AML flags, labels, scores and other outputs of the Service are informational only. They are not legal, regulatory, compliance, tax, investment or financial advice, not a determination that an address, person or transaction is lawful or unlawful, and not a guarantee of any kind.

3.2. A flag shows that an address appears on a list we use at the time of checking. The absence of a flag does not mean an address, counterparty or transaction is clean, and the presence of a flag does not mean it is illicit. Lists are maintained by third parties, may be incomplete or delayed, and may change.

3.3. Notifications may be delayed, duplicated, reordered or missed because of network congestion, chain reorganisations, node or data-provider failures, Telegram or webhook delivery failures, or other causes. A transfer first reported as "seen" may later be reorganised out of the chain. You are solely responsible for your decisions and for your own compliance obligations, including sanctions, AML and reporting duties, and should not rely on the Service as your only control.

4. Territory and sanctions

4.1. The Service is not provided to, and you may not use it if you are: (a) located, ordinarily resident, or incorporated or organised in the Russian Federation, Belarus, Cuba, Iran, North Korea, Syria, the Crimea region, the so-called "Donetsk People's Republic" or "Luhansk People's Republic", or the occupied parts of the Zaporizhzhia and Kherson regions of Ukraine; (b) identified on, or owned 50% or more, individually or in the aggregate, directly or indirectly, by one or more persons identified on, the SDN list, the OFAC Consolidated Sanctions List or any comparable sanctions list that applies to us; or (c) acting on behalf of, or for the benefit of, any such person.

4.2. At registration you declare that none of the circumstances in Section 4.1 applies to you, and you undertake to tell us immediately if that changes. This declaration is a condition of your use of the Service. It also applies to the free beta and to free plans.

4.3. To enforce Section 4.1 we verify eligibility and screen our clients. You agree that we may: (a) ask you to share your Telegram contact (phone number) at registration and check the country code of that number (the number is required to register and without it we cannot provide the Service; we store only the country code, the result of the check, and a salted hash of the number with the date of the check, not the full number); (b) determine your country from your IP address when you use the website, API or web payment pages; (c) require know-your-business ("KYB") information (name, country of registration and registration number) for Business, Scale and API plans; (d) screen your name, Telegram display name, company, e-mail domain and the sending addresses of your payments against sanctions lists on registration and whenever those lists are updated; and (e) request further information and suspend the Service until we receive it.

4.4. You must not circumvent these controls, including by VPN, proxy, anonymising service, a nominee or straw person, a borrowed or purchased Telegram account or phone number, or false information. If we find or reasonably suspect circumvention or a breach of Section 4.1, we will disable your account immediately, without notice and without refund.

4.5. A payment that U.S. law requires us to block (a payment from an address or person on the SDN list, or from a person owned 50% or more, individually or in the aggregate, by one or more such persons) will be blocked and will not be refunded or returned, and we will report it to the competent authorities as the law requires. Any other payment from a person who is on another sanctions list or is otherwise ineligible under Section 4.1 will be rejected and returned to the sending address under Sections 7.3 and 9.2. Screening records are kept for 10 years.

4.6. Nothing in these Terms obliges us to perform in violation of any sanctions or other law applicable to us.

5. Account and security

5.1. Your account is tied to your Telegram account and, where provided, your e-mail. You must give accurate information and keep it up to date, keep your credentials, API keys and webhook secrets confidential, and are responsible for everything done under your account.

5.2. One person or entity may not hold multiple free accounts to avoid plan limits. You may not share an account between several organisations.

5.3. You must tell us promptly of any unauthorised use of your account or API keys.

5.4. You are responsible for the security and availability of your webhook endpoints and for verifying webhook signatures as described in our API documentation at https://trcbeacon.com/docs/.

6. Plans and beta

6.1. The Service is offered in plans (currently from US$9 to US$199 per month, with a free tier and a separately priced API), described on https://trcbeacon.com/#pricing. Each plan has limits, including the number of monitored addresses, supported networks, events and API requests.

6.2. While the Service is in beta it is provided free of charge, "as is", with no service commitments. Features, limits and availability may change, and the beta or any part of it may be suspended or ended at any time. All Sections apply to the beta, except Sections 7 to 9 while it is free.

6.3. We may later introduce paid plans or charge for features that are free during the beta. We will notify you in advance as required by Section 8.3.

7. Fees and payment

7.1. Fees are stated on https://trcbeacon.com/#pricing, in US dollars, and are exclusive of taxes, duties and transaction or network fees. You are responsible for all taxes that apply to you, other than taxes on our income.

7.2. We accept (a) Telegram Stars, paid through Telegram's payment system, and (b) USDT on the TRON network (TRC-20), sent to the payment addresses that we show in the Service. Payment addresses are shown only in the Telegram bot @trcbeaconbot, in your account, or in an invoice issued from your account. We will never ask you to pay to an address sent by e-mail or by a Telegram user other than the official bot. Payments to any other address, on the wrong network, in the wrong token, or in the wrong amount are your risk; we are not obliged to recover them.

7.3. A USDT payment is treated as made when it has received the number of network confirmations stated in the invoice and has passed our screening. Payments must come from a wallet that you control. Payments from third parties may be rejected. A rejected payment, and any overpayment, will be returned to the sending address, less the network fee, after screening of that address, except for a payment blocked under Section 4.5; Section 9.2 applies to the manner of payout. If the amount received is less than the invoiced amount (including because of exchange or network fees), we may apply it to a shorter period or ask for the balance.

7.4. Fees are payable in advance for each billing period. We may suspend or downgrade your account if a payment is not received.

7.5. Stars payments are also governed by Telegram's terms. Telegram, not us, determines how Stars are purchased, their value and the fees that Telegram charges.

8. Renewal, price changes and cancellation

8.1. Stars. Subscriptions paid in Stars renew automatically for the same period at the price at which you subscribed, under the rules of Telegram, until you cancel in Telegram or through the bot. A new price is a new subscription (see Section 8.3). You are responsible for cancelling before the renewal date. Cancellation takes effect at the end of the paid period.

8.2. USDT. USDT payments are prepayment for a fixed period and do not renew automatically. We may send reminders. When the paid period ends, the account reverts to the free tier and monitoring above the free limits is paused.

8.3. Changes. We may change prices, plans, limits or these Terms on at least 30 days' notice, given through the bot, the website, or by e-mail. Changes apply from the next billing period after the notice period. If you do not agree, you may cancel before they take effect; continued use after that date is acceptance. Stars subscriptions: a price change does not alter an existing Stars subscription, which continues to renew at the price at which you subscribed. After the notice period we may stop renewing that subscription and offer a new subscription at the new price, which takes effect only when you confirm it in Telegram; if you do not, the existing subscription ends at the end of the paid period. Security, legal or sanctions-related changes may take effect immediately.

8.4. You may stop using the Service at any time. Cancellation does not entitle you to a refund except as stated in Section 9.

9. Refunds

9.1. Stars. Refunds of Stars payments are governed by Telegram's rules and are given at our discretion. As a matter of policy, we will consider a refund request made within 7 days of the payment if the Service was materially unavailable or unusable during that time because of a fault on our side. Send requests with the command /paysupport in @trcbeaconbot, or to [email protected]. This Section does not limit Section 17.3.

9.2. USDT. USDT payments are non-refundable, except where we failed to provide the Service paid for because of our fault. In that case we will refund the unused part of the fee in USDT to the address from which the payment was made, after we have screened that address and the request against sanctions lists, and after we have deducted network fees. We do not refund to any other address. This manner of payout (sending address, screening, deduction of network fees) also applies to every other return or refund of USDT under these Terms, including under Sections 4.5, 7.3 and 17.3. We will send any USDT return or refund within 10 business days after the obligation arises (the payment is rejected or the refund request is approved), unless screening requires a longer period or the law prohibits the payout.

9.3. No refund is due for suspension or termination because of a breach of these Terms or the AUP, a failure of the eligibility requirements in Section 4, a change of plan limits made at your request, or periods in which the Service was available but not used. Payments that are blocked under Section 4.5 are not refunded.

9.4. Nothing in this Section limits any right that cannot be excluded under applicable law.

10. API and usage limits

10.1. API access is available on the plans that include it. Rate limits, quotas and fair-use thresholds are stated on https://trcbeacon.com/docs/ and in your plan; we may apply technical measures to enforce them, including throttling or temporary blocking.

10.2. You must not exceed limits, share or resell API keys, scrape or bulk-extract data from the Service other than through documented endpoints, attempt to bypass limits or authentication, or use the API in a way that harms the stability of the Service. A key found to be misused may be revoked without notice.

10.3. Where the limits of your plan are exceeded, we may reject requests, pause monitoring of surplus addresses, or ask you to move to a suitable plan.

11. Acceptable use and suspension

11.1. You must comply with the AUP. We may, at our discretion and where we consider it necessary to comply with law, to prevent harm or to protect the Service, suspend or disable any account, address, API key or feature, with or without notice, and reject any registration or payment.

11.2. We may refuse, suspend or terminate the Service to a person that we reasonably believe presents sanctions, money laundering, fraud or reputational risk, even if no specific provision has been breached.

11.3. We may preserve and disclose data to comply with law and valid legal process as described in the AUP and the Privacy Policy.

12. Client data and licence

12.1. You retain your rights in the addresses, labels, notes, rules and other content you submit ("Client Data"). You grant us a non-exclusive, worldwide licence to host, process and display Client Data to provide the Service, to comply with law and to enforce these Terms. After your account is closed we delete Client Data as set out in the Privacy Policy (Section 4.1), except that we keep Client Data that we must keep to comply with law or under a legal hold (AUP, Section 6.1), as controller and only for that purpose.

12.2. You confirm that you have the right to submit Client Data, that your monitoring of each address is lawful, and that you will not use the Service to monitor individuals in breach of the AUP or applicable law.

12.3. We own the Service, including its software, interfaces, documentation, aggregated and derived data that does not identify you, and all related intellectual property. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service during the term for your internal business or personal purposes, in accordance with your plan. You may not copy, reverse engineer, resell or sublicense the Service, or use it to build a competing service.

12.4. We may use aggregated and de-identified statistics about use of the Service to operate and improve it.

12.5. Data from third parties (including Tether and OFAC lists, blockchain data and node or data providers) is subject to the terms of those third parties.

13. Availability

13.1. We provide the Service on a best-efforts basis. We do not guarantee any uptime, latency, detection time, delivery or completeness of data, and we offer no service-level agreement or service credits unless a separate written agreement signed by us says otherwise.

13.2. We may carry out maintenance, with or without notice, and may suspend the Service when needed for security, legal compliance or technical reasons.

13.3. Support is provided through @trcbeaconbot (command /support) and [email protected] on a reasonable-efforts basis.

14. Warranty disclaimer

14.1. To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, and that the Service will be uninterrupted or error-free, or that any AML flag, list or notification will be accurate or complete.

14.2. We do not warrant that use of the Service will make you compliant with any law or regulation, or will prevent loss, fraud, freezing or seizure of assets.

15. Limitation of liability

15.1. To the maximum extent permitted by law, the Provider, its members, officers, contractors and affiliates are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, loss or freezing of assets or virtual assets, regulatory penalties, or costs of substitute services, arising out of or related to the Service or these Terms, however caused and whatever the theory of liability, even if advised of the possibility.

15.2. To the maximum extent permitted by law, the Provider's total aggregate liability arising out of or related to the Service or these Terms is limited to US$100.

15.3. The limitations in this Section apply to the extent permitted by law and do not exclude liability that cannot be excluded or limited by law, including for fraud or wilful misconduct. They are an essential basis of the bargain and apply even if a remedy fails of its essential purpose.

16. Indemnity

16.1. You will defend and indemnify the Provider against third-party claims, and related losses, fines and reasonable costs, arising from your breach of these Terms, the AUP or applicable law, your Client Data, or your misrepresentation of eligibility under Section 4.

17. Term and termination

17.1. These Terms apply from your first use of the Service until terminated.

17.2. You may terminate by cancelling your plan and stopping use of the Service, or by deleting your account through the bot or by written request to [email protected].

17.3. We may terminate or suspend the Service (a) immediately and without refund for breach of Section 4, the AUP or these Terms, for non-payment, or where required by law or by a competent authority; or immediately under Section 11.2, with a refund of the unused prepaid fee; and (b) otherwise on 30 days' notice. If we terminate under (b), or under (a) by way of Section 11.2, we will refund the unused prepaid fee. This is a separate obligation and is not subject to the conditions of Sections 9.1 and 9.2 (fault, discretion): for Stars, we refund in full the latest payment through Telegram (the Telegram API does not allow a partial refund); for USDT, we refund pro rata for the unused period, paid in the manner stated in Section 9.2 (sending address, screening, network fee).

17.4. On termination your right to use the Service ends. Where technically available and lawful, we will let you export your Client Data for 30 days after termination before deletion, unless we terminated under Section 17.3(a). Retention of data after termination is governed by the Privacy Policy.

17.5. Sections 3, 4.5, 4.6, 7 (for accrued amounts), 9.3, 12.1 (to the extent of retention of data and performance of legal duties), 12.3, 14 to 16 and 20 to 24 and any other provision that by its nature should survive, survive termination.

18. Force majeure

18.1. Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, war, terrorism, government action or sanctions, changes in law, failure or congestion of public blockchain networks, failures of Telegram or of hosting, internet or other infrastructure or data providers, cyber-attacks or labour disputes. Payment obligations for amounts due are not excused.

19. Third-party services

19.1. The Service depends on third parties, including Telegram, blockchain networks and nodes, hosting and data providers. We are not responsible for their acts, omissions, availability or terms. Your use of Telegram is subject to Telegram's terms and privacy policy.

20. Governing law

20.1. These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of New Mexico, USA, and applicable US federal law, without regard to conflict-of-laws rules.

21. Dispute resolution

21.1. Before starting formal proceedings, the parties will try in good faith to settle a dispute informally for 30 days after one party's written notice sent to the other (to [email protected] for the Provider). If the dispute is not resolved, it shall be finally resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its rules then in effect, before a single arbitrator, conducted online (by video conference and written submissions). Judgment on the award may be entered in any court of competent jurisdiction. The seat of arbitration is New Mexico, and the language is English.

21.2. Disputes will be resolved only on an individual basis; each party waives the right to bring or take part in a class, collective or representative action, to the extent permitted by law.

21.3. Either party may seek urgent injunctive relief from a court of competent jurisdiction to protect its intellectual property or confidential information, or to enforce Sections 4 and 11. Nothing in this Section limits mandatory rights of a consumer under the law of the country of their residence.

22. Changes to the Terms

22.1. We may update these Terms, subject to Section 8.3. Updates are announced as described in Section 8.3 and the "Effective date" above is revised. The Terms in force at the time of your use apply.

23. Notices and communication

23.1. You consent to receive notices from us electronically: through the Telegram bot @trcbeaconbot, in the Service, on the website, or by e-mail to the address on your account. A notice is deemed received when sent. You should keep your contact details current and not block the bot.

23.2. Notices to us are sent to [email protected] or through @trcbeaconbot. Our address is 1209 Mountain Road Pl NE, #10346, Albuquerque, NM 87110, USA.

24. General

24.1. These Terms, the AUP and the Privacy Policy are the entire agreement between you and the Provider for the Service and supersede earlier agreements on the same subject. If these documents conflict, the order of priority is: these Terms, the AUP, the Privacy Policy, except that the Privacy Policy governs the processing of personal data.

24.2. If a provision is held invalid or unenforceable, the rest remains in force, and the provision is replaced by a valid one closest to its purpose. Failure to enforce a provision is not a waiver.

24.3. You may not assign these Terms without our written consent. We may assign them to an affiliate or a successor to the business, with notice to you.

24.4. The parties are independent contractors. There are no third-party beneficiaries.

24.5. These Terms are made in English. A translation is for convenience only, and the English text prevails.
